Nythan is a regulatory defence solicitor who advises health and social care providers including care homes, care at home providers, GPs, independent hospitals, and the NHS on the entirety of regulatory matters that affect their respective businesses.

He is experienced in successfully advising providers on how to interact with CQC in the manner most befitting to resolve any concerns. The ultimate aim in most interactions is to dissuade CQC or any other regulator from taking action which impacts upon the providers’ ability to act free from excessive scrutiny. He has successfully defended care providers in both civil and criminal courts. He has significant experience of engaging with local authorities in respect of safeguarding concerns and contractual issues. He supports providers with understanding the risks involved in purchasing care businesses contributing to specific regulatory due diligence exercises. He also has experience working with children’s homes and education settings and engaging with Ofsted.

Nythan is skilled at working constructively with both clients and regulators to achieve mutually agreeable solutions. He is ambitious for his clients and is keen for any action taken to keep the end goal in mind. He is conscious of the risk versus reward in embarking on competing courses of action and will ensure that the wider picture that supports action being taken remains in focus. He is confident having worked in the sector for over a decade that there is little that he hasn’t advised upon in the health and social care sector such that he can provide considered and informed advice most attuned to meet his clients’ objectives.

  • Advise providers on CQC regulation and enforcement proceedings, inclusive of warning notices, notices of proposal to impose conditions or cancel registration and appealing notices of decision to the First Tier Tribunal (Care Standards);
  • Challenge assessment reports, including alleged regulatory breaches;
  • Advise in respect of registration matters and ongoing compliance with CQC Regulations;
  • Represent clients when large scale complex criminal charges are brought by CQC;
  • Advise in respect of safeguarding investigations;
  • Draft, negotiate and advise on the interpretation of commercial contracts in healthcare setting;
  • Provide executive level advice on the management of commercial and operational risks to those regulated by CQC.
