Felicity specialises in planning and infrastructure consents, acting for Local Authorities, private developers and Registered Providers. She advises on all type of development including large mixed-use schemes, housing developments (including affordable housing), energy, minerals and waste and large infrastructure projects, notably highways schemes. She also advises on conservation and heritage matters, public rights of way, planning appeals, permitted development rights and planning enforcement issues.

Felicity has significant experience in promoting Compulsory Purchase Orders and CPO compensation claims at the Upper Tribunal (Land Chamber) and advising on Development Consent Orders for the energy sector including drafting bespoke protective provisions and scheme objections.

Felicity has brought and defended numerous Judicial Review challenges to planning decisions. She is also very experienced in drafting s106 agreements and advising on CIL compliance.    

Felicity has a keen interest in the environmental impact to development and advises on EIA scoping, Biodiversity Net Gain requirements and Nutrient Neutrality issues.

Felicity is an active member of the Women in Planning network and Lawyers in Local Government.

 

Notable cases

  • Successfully defending two Judicial Review applications on behalf of East Hertfordshire District Council and Harlow District Council in respect of planning applications for the enhancements to and the widening of the Central Stort Crossing (the Eastwick A414.Fifth Avenue Crossing) over the Stort Valley which will form part of a Transport Corridor between Harlow Town Centre and a proposed new development within the Harlow and Gilston Garden Town and planning applications relating to the Harlow North to Centre Sustainable Transport Corridor, including an EIA screening opinion and Certificate of Lawful Use.
  • Negotiating complex s106 agreements for Lancaster City Council to facilitate important local developments including a development to erect over 200 residential dwellings with affordable housing and provide for associated access, a pumping station, wetlands areas, highways and education contributions.
  • Representing the Port of Heysham to provide strategic planning advice on the Port’s highly valuable operational land and helipad at the Port of Heysham, allocated by the Port as land necessary to support their industrial expansion and development into offshore energy. Her work included preparing a Certificate of Lawful Use to establish the existing use of this site as lawful operational land and representing the Port at the Council’s Local Plan enquiry as the new Local Plan sought to exclude the site from the Council’s Core Strategy Policy to provide the development need in Lancashire for the period up to 2031.
  • Assisting in the making of Compulsory Purchase Orders including the dualling of the A1237 York Outer Ring Road (A19 – Little Hopgrove) on behalf of York City Council which involves advising on special category land and exchange land which form part of the CPO scheme, mines and minerals and the Water Framework Directive.
  • Successfully representing an individual landowner and a small business on compensation claims made to the Upper Tribunal (Lands Chamber) following the compulsory purchase of land under the Metropolitan Borough of Stockport (Hazel Grove) (A6) to Manchester Airport A555 Classified Road Compulsory Purchase Order and obtaining settlements of over £1mil for CPO compensation claims from HS2.
