Carolyn is an experienced lawyer who deals with civil and commercial disputes. She is qualified to practise and represent clients in courts in Scotland, as well as England and Wales. She handles a broad range of civil disputes, having specialised in litigation in Scotland for over 20 years.
Carolyn’s practice in Scotland covers a range of commercial and contractual disputes, with a particular focus on real estate litigation and contested executry estates.
She has extensive experience advising on high value dilapidation claims, keep open clauses, landlord’s consent, irritancy and general landlord and tenant disputes. She also handles complex interdict/breach of interdict actions, contamination of land disputes, issues relating to recovery of heritable property and access and servitude rights. She also deals with challenges relating to boundary and title conditions, nuisance and division and sale actions.
Carolyn acts for clients in court on landlord and tenant / occupier issues arising out of the Electronic Communications Code, defending applications by telecoms operators raised in the Lands Tribunal for Scotland.
Carolyn also regularly acts for clients involved in contentious trust and executry matters, providing advice to executors, trustees and beneficiaries. Her work entails representing clients in court actions involving the appointment of a financial and/or welfare guardian, advising in relation to the validity or interpretation of wills, proving the tenor of a lost will, the removal of executors and legal rights claims.
Being dual-qualified, Carolyn also undertakes cross-border work involving contentious executry matters governed by English law, including providing advice on the Inheritance (Provision of Family and Dependants) Act 1975.
Carolyn is a qualified mediator and offers an impartial and independent mediation service to any parties who wish to seek to resolve their differences in a confidential mediation process rather than embark upon court proceedings.
Carolyn also has a particular interest in sports law and sits on the Board as Honorary Legal Adviser to Commonwealth Games Scotland. She is Chairperson of the Conduct in Sport Panel for Scottish Gymnastics. Carolyn also has the role as a mentor for The R&A Women in Golf Leadership Programme.
