This dispute concerned a project to construct 25 residential units and associated external works at a residential block of apartments in Essex. The Claimant employed the Contractor as design and build contractor to carry out those works.
The Contractor in turn employed an architectural design consultant and to provide detailed design drawings for the works. The Claimant claimed remedial work costs it alleged were required to ensure building regulation compliance, claiming in excess of £6 million for remedial works and associated costs. The Contractor issued a Part 20 claim against the Architect (the Third Party).
This matter raised issues around causation and duty of care and required extensive expert input. The matter was resolved for a small fraction of the claim value and a recovery made against the Third Party.
