Working closely with our national Transport Regulatory team, we advised this client on issues arising from potential flaws found in their transport operation which could have resulted in the loss of their operating licence and thus effectively meaning the company, part of an international group of companies, would not be able to operate in the UK.
The client was keen to understand whether the aforementioned flaws resulted in culpability at various management grades, this being particularly important to them when determining what action could or could not be taken and against whom. The implications of getting this wrong were such that the client could have been left rudderless without any local management being in a position to effectively run the business.
