We acted on behalf of the insured driver who drove into collision with the claimant cyclist as she crossed the road in front of him. The claimant sustained an incomplete spinal injury — there was damage to the spinal cord, but it was not severed. So, she was mobile but as she aged, and in her final years, would be confined to a wheelchair and require 24-hour care.
Dashcam footage suggested that our client was driving too quickly and was slow to brake. We were mindful though, that the claimant was nearly 70 years of age and was keen to put this accident behind her. She had also made a good recovery albeit, she would have problems in later life.
We therefore made an offer and the claim settled for £400,000 – significantly below its potential value of over £2,000,000 and at an early stage so legal costs were kept to a minimum.
