A US citizen (the Claimant) was killed at Heathrow Airport when another US citizen failed to properly engage the handbrake on his hire car causing the vehicle to crush the Claimant. Proceedings were issued in England even though both parties lived in the US. Because both parties lived in the US the relevant law was US law, despite the fact the accident happened at Heathrow Airport.

The Claimant, however, wishes to pursue the claim in England, where his solicitors are based and, presumably, because they feel that damages would be greater The claim is ongoing and proceeds to a determination in respect of the applicable law and any statutory limitation arguments.
