Case study: Ageas Insurance — child brain injury claim

Weightmans settled a child brain injury claim arising out of the fall of a wooden plank as it was being winched above a pavement on a construction site. The child was in a pushchair and sustained a severe head injury resulting in paralysis on one side of the body. 

Two separate insurers had indemnity issues and, after prolonged neuropsychological monitoring of the claimant’s problems, a three way compromise was eventually reached at a settlement meeting and approved by the High Court This was a high value complex claim worth over £2,000,000. There were sensitivities involved because of the age of the claimant. We were able to settle the claim quickly and limit legal costs.
